Brief background

First National Bank of Namibia Ltd are my former employer. I devoted eight years of my career to First National Bank of Namibia Ltd, starting in February 2013, with a strong commitment to my role and the company. Throughout this time, I consistently performed my duties with integrity and commitment. I was dedicated to my role and committed to the company. I believed in the work I did and the integrity of the company. However, my experience took a devastating turn when I became entangled in a legal dispute that has significantly impacted my life.


In 2018, I was contacted on my private number, by an investigator from the Namibian Police C.I.D. division (Whk), requesting a statement regarding fraud allegations leveled against my then employer, First National bank of Namibia Ltd. A re-advance application for N$60,000.00 in the name of Ms. Kahatjipara, a matter currently still under dispute before the High Court of Namibia (Case No: HC-MD-CIV-ACT-CON-2019/05422).


I answered questions posed by the police investigator regarding this matter and a statement was compiled at Windhoek @Parkside, 130 Independence Avenue Ground floor, FNB Secured Lending, during official work hours. I chose this location because it was work related. My signature appears on this application under witness. Despite the signature being limited to witness capacity, I had found myself entangled in a legal battle that turned my life upside down. It is imperative that I mention the date of this application in dispute which is April 2013. In April 2013 I was only two months permanently employed at FNB Namibia. Following the trail of events in 2017, from initial inquery into the matter by Ms. Johanna Kahatjipara, it is evident that this application did not exist before June 2017. Plaintiff has undeniable proof pinning her location nowhere in or near FNB on date of application.


Despite the critical nature of the allegations, FNB never briefed, questioned, or discussed these allegations with me. Despite the gravity of the allegations, at no point did FNB engage me on this serious matter. When I asked the author of the application about the allegations, I was told internal investigations were handling it, yet no internal investigator ever reached out to me directly. This lack of engagement from FNB shows a concerning level of negligence. It left me, an innocent employee, vulnerable and without the necessary support or protection.


Late in 2019 I went on maternity leave. I returned from maternity leave in March 2020, during the height of the COVID-19 pandemic. I continued working through the challenges posed by the COVID-19 pandemic, however, I was constructively dismissed from my position in May 2021. Since then, my life has been a series of escalating legal battles and personal hardships.


This dismissal was significantly influenced by FNB’s failure to address the fraud allegations properly from the onset. Their failure to involve me in the internal investigation ultimately contributed to the constructive dismissal I faced in May 2021.


Following the interference with my employment contract and subsequent dismissal, my situation worsened. FNB manipulated my home loan statements. This action by FNB willfully and with intent, tempering with financial records of an individual to obscure their financial condition on paper, further conquers my unfounded exclusion from internal investigations, the intent to implicate me in this matter without my knowledge. FNB obtained a judgment for the sale in execution of my primary property (Case No: HC-MD-CIV-ACT-CON-2022/04982), a property I fought to defend in the High Court, but ultimately my defense was not considered. Additionally, I was pursued, arrested, and detained for nine days by the Namibian Police, C.I.D Rehoboth. An experience that was both traumatic and unjust. The criminal investigation, instead of focusing on fraud or other relevant matters, seemed intent on having me declared mentally ill and institutionalized—the matter is ongoing in the Rehoboth Magistrate Court.


The legal and personal difficulties I face today are rooted in the case of Ms. Kahatjipara vs FNB. The aftermath has left me unemployed, financially strained, in a constant state of legal uncertainty and a constant threat of losing my primary home.

I was served with a third Notice of Sale in Execution. Despite the legal rights that should protect me, I find myself in desperate need of legal representation to challenge and set aside this court order, so that my family and I can retain our home.

NAOA serves as a Guardian of Proprietary Rights, standing up for individuals like me who are struggling to defend their property rights.

Article 8 Respect for Human Dignity


(1) The dignity of all persons shall be inviolable.


(2)(a) In any judicial or in other proceedings before any organ of the
State, and during the enforcement of a penalty, respect for
human dignity shall be guarenteed.


(b) No persons shall be subject to torture or to cruel, inhuman
or degrading treatment or punishment.


Article 11 Arrest and Detention

(1) No persons shall be subject to arbitrary arrest or detention.

Final word

I am sharing my story not just to inform, but to appeal to you for support.
